新京报快讯(记者 王俊)不必要羁押是司法实践中的痼疾,今天(1月18日)最高检检察长张军在全国检察长会议上表示,要进一步降低逮捕率、审前羁押率,扩大非羁押手段适用势在必行。

BJNews (Reporter: Wang Jun) Unnecessary detention has long been a problem in judicial practice in China. Zhang Jun, the Chief Prosecutor of the People’s Procuratorate (the SPP), during an address to the national chief prosecutors conference today (January 18, 2020), said that the rates of arrest and pretrial detention must be further decreased, and that it is imperative to expand implementation of non-incarceration measures.

此前,不少律师反映,在办理刑事案件过程中,犯罪嫌疑人在法院判决前,以羁押为常态,以取保为特例。但法理上来讲,应当是慎用羁押,以取保为常态的。

Previously, many lawyers have reported that, when representing defendants in criminal cases, it is common for their clients to be detained before trial and exceptional for them to be released pending trial.

张军表示,要进一步降低逮捕率、审前羁押率。能不捕的不捕,能不羁押的不羁押,有效减少社会对立面。

Zhang Jun indicated that arrest rates and pretrial detention rates should be further lowered. He stated that if suspects do not need to be arrested or detained, they should be released, which would effectively reduce social conflict.

张军强调,检察机关要进一步树立“少捕慎诉”的理念,用更积极的举措去落实,同时通过检察监督,运用检察监督,运用检察智慧,引领执法司法机关和社会接受、认同、支持。

Zhang Jun stressed that prosecutors should deepen their understanding of “reducing arresting and cautious prosecution,” and implement this idea more proactively.
